{"id":1254,"date":"2021-09-17T10:28:21","date_gmt":"2021-09-17T14:28:21","guid":{"rendered":"http:\/\/elephanteardesign.com\/ragc\/?p=1254"},"modified":"2022-09-21T09:53:23","modified_gmt":"2022-09-21T13:53:23","slug":"may-i-come-in","status":"publish","type":"post","link":"https:\/\/elephanteardesign.com\/ragc\/may-i-come-in\/","title":{"rendered":"May I Come In?"},"content":{"rendered":"<p><strong>More Complaints \u2013 More Fines<\/strong><\/p>\n<p>The National Association of REALTORS\u00ae, Ohio Division of Real Estate and Professional Licensing, and MLS Rules and Regulations all address the issue of access to listed property.\u00a0 And, CABR continues to receive complaints pertaining to unauthorized or non-compliant access.<\/p>\n<p>Below are just a few examples of activities that can result in a $1,000 \u2013 $15,000 fine from the Professional Standards Committee for violating the Code of Ethics\u00a0<em>(Note:\u00a0 ODRE and MLS have separate schedules)<\/em>:<\/p>\n<ul>\n<li>Entering a listing early or arriving\/staying late \u2013 whether it\u2019s a few minutes or a few hours outside the scheduled time<\/li>\n<li>Not making an appointment or waiting for a confirmation<\/li>\n<li>Making an appointment and allowing another licensee to use it (think teams)<\/li>\n<li>Leaving the property with buyers or others not authorized to be in the property unsupervised (home inspections [inspector and\/or buyer], contractors, etc.)<\/li>\n<li>Allowing a non-real estate licensee to access the property without a real estate licensee present \u2013 without express written consent from the seller (buyers, inspectors, unlicensed assistants, photographers, etc.)<\/li>\n<li>Providing a lockbox code to a person not authorized to have it<\/li>\n<li>Failing to secure the property<\/li>\n<li>Not following showing instructions<\/li>\n<li>Allowing video chat or pictures\/videos to be taken without express written consent from the seller<\/li>\n<\/ul>\n<p>A listing agent can provide instructions in Showing Time to convey the seller\u2019s authorization for the presence of an unlicensed individual on the property without their agent.\u00a0 Without that, a buyer\u2019s agent should contact the seller to determine whether their buyer can be on the property for the inspection (or something else) without the presence of a real estate licensee.\u00a0 Without express, written permission from the seller, the buyer cannot be there without their agent.<\/p>\n<p>If a complaint is against an unlicensed assistant or a non-member licensee (someone who is licensed, but has not joined a board) under a member broker, the complaint\u00a0<strong>could<\/strong>\u00a0be processed against the broker and\/or any management-level member with the responsibility of supervising the agent or unlicensed assistant.\u00a0\u00a0<em>It should be noted that the broker and\/or management-level licensee can be joined in a complaint as a respondent, even if the agent is a member.<\/em><\/p>\n<p>Being provided access to someone\u2019s property is a privilege that should not be taken for granted.\u00a0 Make sure you \u2013 and those you have a duty to supervise \u2013 are following the rules.<\/p>\n<p>Click on the links below for related articles from CABR and the Ohio Association of REALTORS\u00ae.<\/p>\n<p>And, remember\u2026.if something is amiss at the property, contact the listing agent.<\/p>\n<p><a href=\"http:\/\/elephanteardesign.com\/ragc\/wp-content\/uploads\/2022\/08\/Appointments-and-Showings-7-20.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">CABR Appointments and Showings<\/a><\/p>\n<p><a href=\"https:\/\/www.ohiorealtors.org\/blog\/304\/legally-speaking-is-it-ever-ok-to-let-a-buyer-inspector-in-a-listing-without-you\/\">Legally speaking: Is it ever OK to let a buyer, inspector in a listing without you?
